Accused absent.
No exemption application has been moved by the counsel for
the accused, and oral exemption is made by the counsel for the accused, on
the ground that accused is not well. He relied upon the photocopies of
certain documents, these documents not issued by any doctor, nor is there
any doctor report suggesting inability of the accused to appear before the
court. The accused is stated to be appearing through VC, however, there is
no ID document to suggest that she is the accused.
There is no Vakalatnama filed on behalf of the accused and
this is the second memo of appearance filed by the different counsel on
behalf of the accused today.
It appears that the accused is deliberately not appearing in the
court and delay tactics are being played to avoid the appearance in the court
for the first date and formal appearance for formal bail and further
proceedings.
Issue NBWs against the accused on filing of PF within 07 days
from today for next date. Adjournment due to absence of accused, cost of
Rs.5000/- is imposed upon the accused to be paid by the accused to the
complainant on the next date.
Be put up on 09.01.2025 for appearance of accused and further
proceedings.
