Perusal of the record reveals that legal demand notice sent to the
proposed accused returned to the sender. However, Ld. Counsel for complainant
submits that the same has been sent at the last known address of the proposed
accused. It is further submitted that submissions in this regard have been made in the
complaint and affidavit in this regard by the NDOH.
It is submitted that the present complaint was filed on 21.01.2025.
Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) shall be followed in the cases
filed on or after 01.07.2024.
In view of first proviso of Sec-223 of BNSS, 2023, let court notice be
issued to the proposed accused for NDOH upon filing PF(within 45 days).
