Stage : Today the matter is listed for appearance of complainant and
consideration.
Proceedings :
• Ld. counsel for the complainant has stated that he is counsel for the
complainant in the instant case having Vakalatnama and instruction to
withdraw the matter on the ground of filing this case afresh at proper
jurisdiction owing to technical difficulty and the statement of the Ld.
counsel for the complainant is recorded to this effect.
Order :
• In view of the record, submissions and statement of the Ld. counsel for
the complainant, the case is allowed to be withdrawn with liberty to file
afresh as per law.
• Keeping in view Section 142 NI Act, the present complaint case is
returned to the complainant to file the same before the court having
jurisdiction as per the provision of law.
• Ahlmad of this court is directed to hand over the original file to the
complainant, if the same is received upon receiving self attested copy of
the file from the complainant / counsel.
• File be sent to record room for consignment after due compliance of the
order.
