Ld. Counsel for the accused.
Oral exemption application has been moved on behalf of the
accused. Heard. Allowed only for today.
The counsel for the accused has stated that the complainant in
his para no. 14 has mentioned that the bank account of the complainant
society is maintained at RBL Bank, Jagriti Enclave, Anand Vihar, Delhi-92.
However, the complainant has also mentioned that the complainant’s
cheque was presented and returned in East Delhi.
Ld. counsel for the complainant has stated that the bank was
earlier in Jagriti Enclave and now in Mayur Vihar, Phase-II, Delhi. The AR
of the complainant has orally stated that when the cheque was dishonoured,
the bank account was maintained in Jagriti Enclave. Let the complainant
file an affidavit of verification of the above fact alongwith the copy of
passbook of the bank account and the date of transfer of bank account.
The matter is adjourned today as the similar direction was
already given on 21.05.2024. The cost of Rs.500/- is imposed upon the
complainant to be paid in the court.
Let the matter be listed for clarification by the complainant on
the next date of hearing, failing which the court will be constraint to take
steps under Section 322 Cr.P.C.
