Undersigned is holding Court from Rouse Avenue District Court.

Mr. Naushad Alam, Ld. Counsel for accused alongwith accused through VC.
Ld. Counsel for accused has orally prayed for cancellation of NBWs issued against the
accused on the last date of hearing on the ground that on the LDOH accused could not appear as his
mother was not well and on the last to last date he did not appear as he could not join VC due to
technical issues.
Heard.
Perusal of record shows that on 17.01.2025 similar submissions was made regarding the
mother of the accused not being well and the exemption application was allowed.
Thereafter on the next two dates the accused could not appear and the reasons mentioned
for his non appearance are not satisfactory and no medical documents have been furnished regarding
the ailment which the mother of accused is suffering from. Due to the conduct of the accused, the
complainant has suffered delay in the matter and matter is still pending at the stage of framing of
notice.
Considering the above, NBWs are stayed against the accused subject to payment of cost
of Rs. 5000/- today itself to the complainant via on-line mode on 9650677902.
It is made clear that if the cost is not paid today, then on the NDOH further cost of shall
be imposed for delay in complying with the order of this Court.
