complainant.
Part arguments heard.
During the course of arguments, it transpires that there is no
document whatsoever to show that the complainant is the President of RWA
in question. Ld. Counsel relies upon an order of Hon’ble High Court of Delhi
dt. 30.04.2026 passed in WPC No. 4616/2026 wherein, complainant is stated
to be the President of RWA. However, perusal of the records shows that the
same was only a submission made by Ld. Counsel for the petitioner therein/
complainant herein.
It is further submitted that the Registrar of Co-operative
Societies did not object to the submission of Ld. Counsel that the
complainant was the President, IO has also not denied the complainant being
the President, however, the submissions cannot be considered for the purpose
of deciding the present application as the same has been filed u/s 175(3)
BNSS which entails grave consequences in case the application of the
complainant is allowed and order for registration of FIR is made. Therefore,
the submissions of Ld. Counsel are liable to be rejected. He is at liberty to
file the documents pertaining to the complainant being the President of RWA
in question within two weeks from today.
Put up for filing of above-mentioned documents and arguments
on 27.06.2026.
