Ram Choudhary (Krishna Nagar) Present: Complainant with Ld. Counsel Sh. Devender Kasana. Accused alongwith Ld. counsel Sh. Sikandar. Stage : The matter is at the stage for framing of notice, admission denial and consideration on the application under Section 145(2) of NI Act. Proceedings : The counsel for the accused has stated that matter may be proceeded for trial, as accused does not wish to plead guilty for cheque dishonor, and formal framing of notice may be framed with in terms of 251 CRPC/ 223 BNSS. • Ld. counsel for the accused submits that he will file fresh Vakalatnama again. Order : Formal notice is framed, the accused has not pleaded guilty having understood the complaint filed against him and claimed trial. Admission/denial of documents also done. Accused states that he will not dispute the genuineness and correctness of dishonor Cheque & memo. • Hence, 02 witnesses cited in list of witnesses by complainant at serial no. 2 & 3 stand dropped from said list. • No application under Section 145(2) NI Act has been filed by the accused despite opportunity given vide order dated 18.12.2024 and despite the cost imposed, none is paid. • The only defense of the accused, as per the notice framed was that the cheque was given as security. • Therefore, complainant is not recalled for his cross-examination and matter is directly listed for recording of statement of accused under Section 313 Cr.P.C and DE on 01.06.2026. • Interim bail of the accused is granted on oral request, for purpose of allowing the parties to settle the matter. Fresh bonds to be filed by the next date. • Accused is directed to appear physically for the same, no exemption application shall be entertained. • In case accused wishes to lead DE, accused is directed to file list of witness alongwith application under Section 315 Cr.P.C on the next date, with advance copy to the other side within 10 days from today. • Accused to appear physically on the next date, failing which the bail of the accused will be cancelled without further opportunity and bail bonds will be forfeited.
