Fresh suit was received on assignment on
20.12.2023. It be checked and registered as per rules.
Present: Sh. Vinay Kumar Pandey, Ld. Counsel for plaintiff.
Ld. Counsel for the plaintiff has submitted that
statement of truth is on record, the matter could not be settled in
pre litigation mediation, therefore the non-starter report from
Mediation is also on record, the case is within limitation and
territorial jurisdiction of the court, therefore defendants may be
summoned.
I have considered the submissions and perused the
judicial record.
Issue summons for settlement of issues to the
defendants on filing of PF/RC/AD, authorised courier and speed
post as per rules.
Ld. Counsel for plaintiff is directed to file an
affidavit furnishing e-mail address of the defendants at the
earliest.
Plaintiff is directed to get the service to the
defendants effected through e-mail, by sending the soft copies of
plaint and other annexed documents in PDF form on the e-mail
ID of the Court i.e., djcomm02-east@ddc.nic.in. Plaintiff is also
directed to mention the date and the time of sending the same on
the PF and PF be filed within fifteen days as per rules
Ahlmad is directed to send the aforesaid documents

in PDF form along with summons for settlement of issues to the
defendant through e-mail on the e-mail ID of Nazarat Branch at
the earliest for service of the defendants.
If the defendants is served, he/she/it is directed to
file WS and affidavit of admission/denial of documents within
stipulated period of thirty days from the date of service and
supply advance copy of the same in e-form to Ld. Counsel for
plaintiff at least one week prior to the next date of hearing.
