PW-3 further partly cross-examined and
discharged for today. Her cross-examination is deferred for
reasons mentioned in her deposition.
Application U/o 1 Rule 9 CPC filed on behalf of
defendant No. 1 is dismissed as withdrawn on submissions of
counsels for defendant No. 1.
Counsel for plaintiffs has submitted that plaintiffs
shall shortly file an application U/o 1 Rule 10 CPC seeking
impleadment of wife of defendant No. 1 as defendant in
present suit in view of documents filed by defendant No. 1
with his application U/o 7 Rule 11 CPC. Counsel for plaintiffs
has further submitted that plaintiffs will also file appropriate
amendment application in plaint thereafter.
At this stage, an application U/s 151 CPC moved
on behalf of defendant No. 1 for clarification/written statement

to be taken on record. Copy supplied.
Be put up for remaining cross-examination of
PW-3 and for reply and arguments on application filed by
defendant No. 1 today for 14.10.2025.
