Present: Shri Gulzar Ali, Ld. Counsel for plaintiff a/w plaintiff.
Shri Yogesh Guar, Ld. Counsel for defendant through VC.
PW-Sh. Rekh Raj Meena, Jr. Engineer from MCD is
present.
Ld. Cousnel for defendant seeks an adjournment stating that
he has filed an RTI in MCD department with respect to issuance of
notices by MCD to the defendant. It is further submitted that he has not
received the reply to the RTI application which probably get within 4
days from today. It is further submitted that these replies are relevant and
required to be confronted to witness Sh. Rekhraj Meena from MCD.
There is no such document has been placed on record to
support the above said plea at this stage.
In view of submissions made by ld. Counsel for defendant
and in the larger interest of justice, one last and final opportunity is given
to the defendant subject to cost of Rs.1000/- to be paid to the plaintiff and
subject to diet money of witness shall be born by defendant on NDOH.
PW Sh. Rekh Raj is bound down for NDOH.
