Present: Sh. Durgesh Pal, Ld. Counsel for decree holder.
Ld. Counsel for decree holder has submitted that he
has filed list of documents in accordance with Order XI Rule 1 of
Commercial Courts Act, 2015 along with certified copy of the
award dated 13.10.2021 passed by Arbitral Tribunal and copy of
appointment letter of sole arbitrator, the same are taken on
record.
Issue notice of the execution petition to Sh. Rajiv
Gupta, Resolution Professional who is stated to be functioning
from the address of the JD on filing of PF/RC/AD, authorized
courier and speed post as per rules.
Ld. Counsel for DH is directed to file an affidavit
furnishing e-mail address of the Sh. Rajiv Gupta, Resolution
Professional at the earliest.
Ld. Counsel for DH to get the service to the Sh. Rajiv
Gupta, Resolution Professional effected by sending the soft
copies of execution petition and other annexed documents in
PDF form on the e-mail ID of the court i.e., djcomm02-
east@ddc.nic.in. DH is also directed to mention the date and time
of sending the same on the PF and PF be filed within 15 days as
per rules.
Ahlmad is directed to send the aforesaid documents in
PDF form along with the notice to the Sh. Rajiv Gupta,
Resolution Professional through e-mail on the e-mail ID of
Nazarat Branch at the earliest.

If the Sh. Rajiv Gupta, Resolution Professional is served,
he is directed to file reply, if any and supply advance copy of the
same to Ld. Counsel for the DH at least one week prior to the
next date of hearing.
