It is submitted by ld. Counsel for plaintiff that he has already filed
replication to the WS on behalf of defendant No.1 and 2.
Replication to the WS filed on behalf of D 3 is filed, copy supplied.
It is submitted by Ld. LAC for plaintiff that the plaintiff admits the
documents i.e. copy of sale deed dt. 06.10.1970 in respect of suit property
showing the ownership of father. Property Tax receipt of suit property,
registered sale deed of property situated at Khoda Colony, Electricity
connection installed at Khoda Colony property and death certificate of parents.
All other documents filed on behalf of defendant are denied by the plaintiff.
It is submitted by ld. Counsel for defendant that defendant denies all the
documents filed on behalf of plaintiff.
Pleadings are complete. On the basis of pleadings of parties, the
following issues are hereby framed.
ISSUES
1. Whether the defendant proves the gift deeds
registered on 02.02.2012 executed by father of
parties in favour of defendant No.1 and 2? OPD
2. Whether the plaintiff is entitled for partition, as
prayed for? OPP

3. Whether the plaintiff is entitled for permanent
injunction as prayed for? OPP
4. Relief.
No other issue arises nor pressed for nor onus of proof objected to.
Both the sides to file their list of witnesses within 15 days from today.
Plaintiff to file his evidence by way of affidavit with advance copy to the
opposite side.
