Pr.: Sh. Sachin Dev, Ld. Counsel for the appellant along with
appellant in person.
An application seeking stay of impugned judgment dated
27.03.2023 and order on sentence dated 31.03.2023 has been
filed alongwith appeal.
Submissions heard. Record perused.
Vide order on sentence dated 31.03.2023 passed by Ld.
Trial Court, appellant was sentenced to pay compensation of Rs.
3,60,000/- i.e. the amount of cheque in question along with
simple interest at the rate of 9% p.a. from the date of filing of the
complaint, within a period of 30 days and in default thereof, to
undergo simple imprisonment of two months.
The appellant is directed to deposit 20% of the
compensation amount by way of FDR in the name of court on or
before the next date of hearing.
In the meantime, operation of the sentence dated
31.03.2023 is hereby suspended u/s 389(1) Cr.P.C. till pendency
of the present appeal.
Appellant is further admitted to bail on her furnishing a
personal bond in the sum of Rs. 15,000/- alongwith one surety in

the like amount. Bail bond furnished. Same is accepted.
Let notice of appeal be issued to the respondent on filing
PF and RC for next date of hearing.
TCR be summoned for the next date of hearing.
Re-notify the case for further proceedings on 08.12.2023.
Copy of order be given dasti to the appellant.
