Present: Sh. Saurabh Rastogi Ld. LAC with plaintiff.
Defendant no.3 in person.
It is prayed by both the parties that Local Commissioner be
appointed by this court to inspect the suit property and to file a report and
recent photographs for determining addition/alteration in respect of the
suit property. It is further prayed that they do not have means to engage
an Advocate to defend the case and therefore request for Legal Aid.
Heard. For suggesting the actual position, it is a fit and
appropriate that a local commissioner visits the suit property and to take
photographs of the suit property from all different angle and file his
report.
The Local Commissioner shall inform the parties concerned
through telephone or Whatsapp for his visit, in advance and submit his
report before the next date of hearing. Local Commissioner shall take
police assistance if any, in case of untoward incident.
Ld. Secretary DLSA East is requested to appoint Local
Commissioner and consider the fees of the Ld. Local Commissioner as
per rules.
Re-notify for report of Local Commissioner on 26.04.2025.
Copy be given dasti to Ld. Local Commissioner, DLSA and
parties.
