Heard. File perused. On the basis of pleadings and supporting
documents, following issues are framed:-
1) Whether Mr. Dharmendra Tiwari died in a motor vehicular
accident happened on 20.05.2023 at 02:00 P.M., near Shiv Mandir, Lal
Kuan on Bulandshahr Road, within the jurisdiction of Police Station-
Wave City, District-Rural (Commissionerate Ghaziabad), due to rash
and negligent driving of vehicle bearing registration No.
UP-14FT-6591 (Canter), driven by respondent No.1/Mahesh Kumar?
(OPP)
2) Whether the petitioners are entitled to compensation on account
of said death and if yes, to what extent and from whom? (OPP)
3) Relief?
