r/w Section 151 CPC registered as IA no. 1/26.
It is submitted by Ld. counsel for DH that vide order
dated 09.07.2026 in RFA No. 960/2023 titled as
‘D.K. Saxena vs. G.P.
Saxena’, the appeal filed by the JD has been dismissed. He has further
submitted that in view of the same, warrant of possession qua the suit
property be issued.
Heard. Perused.
No one has appeared on behalf of the JD despite
repeated calls since morning. The Court is not inclined to adjourn the
matter any further, specially when the RFA filed by the JD has already
been dismissed.
As such, issue warrant of possession in respect of suit
property on filing of PF and certified copy of the site plan with
permission to break open the lock with police aid, if need arises.
DH shall file an affidavit alongwith PF that there is no
stay from the Higher Court on the present execution proceedings.
DH to appear before Ld. ACJ-East, KKD Delhi on
07.10.2026. Put up for report on warrants on 23.10.2026.
Steps be
taken within one week from today.
The aforesaid application is disposed of accordingly.
