ENM filed on behalf of Union of India. The same be
taken on record.
Ld. Counsel for MCD stated at bar that the proceedings
in the instant matter has been stayed by the Hon’ble High Court and
undertakes to file the copy of the same in this regard on or before the
next date of hearing.
Counsel for MCD further submits that though the stay
has been granted in the present matter, however, since the same is not
reflected in the order dated 18/19.12.2023, she has already moved an
application for modification in the said order and also undertakes to
file the copy of that order by the NDOH.
On the other hand, counsel for the DH submits that
neither there is any stay granted in favour of the JD- MCD nor any
payment towards the decreetal amount has been deposited by either of
the JD in the present matter.
In these circumstances, put up for filing of copy of the
order of the Hon’ble High Court/ further proceedings on 12.01.2024.
