Naveen Khatana vs State
09.08.2023
Present: Mr. B P Sharma, Ld. Counsel for the petitioner.
None for the State.
Inspector Surender Kumar, SHO PS Laxmi Nagar is present
on behalf of Inspector Narender Kumar.
The present revision petition has been filed in challenge
against the order dated 15.04.2023 wherein the Ld. MM had declared
petitioner Naveen Khatana as a proclaimed person.
Since the ld prosecutor is on leave and no substitute
prosecutor has been assigned for the regular work of this court today and
also because the main IO is not present, the petition cannot be heard
today.
At this stage, the ld counsel for the petitioner has prayed
that the interim protection against coercive action be extended till the
next date.
The court would record that the interim order dated
05.08.2023 was passed as notice had been issued to the IO for today.
Today, the police officials have appeared on behalf of the IO and the
case file has been perused by the court. Notwithstanding the hearing on
the present revision petition with respect to the order of the Ld. MM
dated 15.04.2023 declaring the applicant a proclaimed person, the
preceding coercive process viz NBWs against the applicant remain in
-- 1 of 2 --
operation. While the declaration of the applicant as a proclaimed person
is the subject of the present challenge, the preceding issuance of NBWs
has not been called into question by the applicant. Hence, the court finds
no grounds to extend the interim order dated 05.08.2023. The said order
is vacated.
List for submissions on 22.08.2023.
