that the present application may be allowed subject to heavy cost as
already cost of Rs. 12,000/- was imposed upon the plaintiff and
sufficient opportunities were given.
In view of the submissions the application U/o 9 rule 4
CPC is allowed subject to cost of Rs. 20,000/-. Rs. 15,000/- be
given to the other party and Rs. 5,000/- be deposited in the DLSA,
East. Application is disposed off and the present application is
consigned to record room.
