PW1 Shri Sarvottam Kumar Rana has tendered evidence by
way of affidavit in examination in chief but none has appeared on behalf of
the defendant since morning despite three calls for cross examination. It
appears that defendant is not interested in cross examination as on last date
of hearing date was communicated to the defendant for cross examination.
Nil opportunity given for cross examination and PW1 discharged.
Ld. Counsel for plaintiff has submitted that plaintiff wants to
examine one more witness. Witnesses be summoned on PF subject to list of
witness already on record. Diet money shall be payable at the spot.
A cost of Rs. 5000/- was imposed on plaintiff vide order dated
16.02.2026 payable to defendant but defendant has not appeared.
Accordingly, cost be paid with legal aid.
Put up for remaining PE on 17.03.2026.
