Present: Sh. Abhishek Negi, Proxy Counsel for plaintiff.
Ms. Divya, Ld. Counsel for defendant.
No rejoinder and affidavit of admission-denial of
documents filed. Again time sought on behalf of plaintiff to file rejoinder
and affidavit of admission-denial of documents on the ground that main
counsel is not well.
Let the rejoinder, if any and affidavit of admission-denial of
documents be filed within 15 days positively with advance copy to
opposite party, in failure opportunity of plaintiff to file the same shall be
closed without any further order.
Admission-denial of documents conducted in view of
affidavit of admission-denial of documents. As per the pleadings of the
parties following issues are framed as under:-
ISSUES:
1. Whether this court has no territorial jurisdiction to
entertain this suit as alleged? OPD
2.Whether plaintiff is entitled for decree of amount of
Rs. 11,34,648/- as prayed for? OPP
3. Whether plaintiff is entitled for interest, if so, at what
rate and for what period? OPP
4. Relief.
No other issue arises or pressed.
List of witnesses be filed by both parties within one week
positively thereby exchanging copies to each other.

Case management hearing done with the consent of the
parties. The dates i.e. 03.02.2026, 04.02.2026 and 05.02.2026 are fixed
for P.E.
Put up for DE on 16.02.2026, 17.02.2026 and 18.02.2026.
Advance copy of affidavit shall be supplied by the plaintiff
to defendant 7 days prior to next date of hearing and by the defendant to
plaintiff similarly.
It is being made clear to both parties that dates are given as
per accommodation of case diaries of both the counsels and no plea for
adjournment shall be considered on dates fixed by this Court for PE /
DE. Both the parties alongwith their respective counsels shall appear on
the next date of hearing at 10.30 AM sharp.
