Copy of appeal has been supplied to the respondent.
Ld. Counsel for respondent submits that there is an
application for seizure of the passport of the appellant/accused as
the respondent has apprehension that he may flee to Zambia
(South Africa).
Notice of this application sent to the appellant/accused is
not received back.
Counsel for the appellant submits that he has not received
copy of the application. Proxy counsel for the respondent
submits that he will provide copy of the application to counsel of
the appellant by Whatsapp, today itself.
Vide order 09.05.2023, the appellant was directed to
deposit 40% of the cheque amount within 60 days. Ld. Counsel
for the appellant submits that the appellant is supposed to deposit
the amount within 60 days and he will comply with the order
within stipulated time.
Ld. Counsel for the appellant submits that he has filed 4
appeals, out of which 3 appeals have been assigned to this court
and one appeal has been assigned to the court of Sh. Arun
Sukhija, Ld. ASJ, East. He requests for withdrawal of the said
appeal and assigning of the same to this Court.

All the matters pending between the same parties are
required to be decided by the same Court. Accordingly, appeal
no. 69/2023 pending before the Court of Sh. Arun Sukhija, Ld.
ASJ, East is withdrawn and is self assigned. A copy of this order
be sent to the Court of Sh. Arun Sukhija, Ld. ASJ, East for
information and compliance.
TCR has been received.
Put up for arguments on the appeal as well as on
application of the respondent for 14.07.2023.
