Present : Ms. Nikita, Ld. Counsel for the plaintiff.
An application under Order VII Rule 10(3) read with Section 151
CPC has been filed on behalf of the plaintiff seeking return of the plaint along
with the original documents and court fee.
Learned counsel for the plaintiff submits that this Court does not
have territorial jurisdiction over the subject matter of the suit and, therefore,
prays for return of the plaint, original documents, and court fee to enable the
plaintiff to file the same before the Court of competent jurisdiction.
In view of the submissions made and considering the facts and
circumstances of the case, the application is allowed.
Accordingly, the application stands disposed of.
Let the plaint be returned in accordance with the provisions of
Order VII Rule 10 CPC after due compliance. The original documents filed by
the plaintiff along with the plaint and the court fee shall also be returned to the
plaintiff as per rules, after taking certified copies thereof on record and
obtaining due acknowledgment.
After due compliance, the file be consigned to the record room
after completing the necessary formalities.
