Accused Rajesh @ Kanny is on bail. Sh. Manish Vashisth, advocate for complainant Changa @ Birju. Sh. R.G. Goswami, advocate for accused. Counsel for accused wants time as he is newly engaged counsel whereas prosecution wants that charge for more serious offence, than Section 324 IPC be framed. Counsel for accused is directed to file his vakalatnama. Counsel for complainant informed that in the incident dated 14.09.2020, the complainant had suffered grievous injuries in his stomach and was taken to LBS hospital where he remained admitted for 2-3 days and 20 stitches were given for his injuries. The complainant was arrested in cross case FIR No. 377/2020 on 16.09.2020 when he was already admitted in LBS hospital as already come on record in the statement of the IO in cross case. He further stated that after the arrest, the complainant was sent to jail and from there after 10-12 days, he was referred to to DDU hospital from custody where his stitches were removed. Counsel for complainant stated that the IO has not properly investigated the matter and filed the chargesheet only under Section 324 IPC instead of 307 or 308 IPC. He wants to move an application for giving directions to the police to further investigate the matter. -- 1 of 2 -- 2 Let the Medical Superintendent of LBS Hospital to produce the entire medicate record of the patient Changa @ Birju bearing MLC No. 6933 who was examined on 15.09.2020 at 1:20 a.m. It be also informed whether the patient was admitted in the hospital and was given stitches as alleged above or not. IO is directed to appear in person to clarify the submissions made on behalf of the complainant. Report be also called from DDU Hospital whether the complainant Changa @ Birju was brought to the hospital for removal of stitches in the month of September or October, 2020 from Tihar Jail itself and if any treatment was given to him, then the complete record be produced.
