Ld counsel for plaintiff submits that though the present suit has been filed under Order XXXVII CPC, however, the same may be treated as ordinary suit for recovery of money. Considering the facts and circumstances and in view of the judgement of Hon’ble Delhi High Court in Associate India Financial Services Ltd. vs. Atwal & Associates, CS(OS) No. 2109/2002 decided on 9 August, 2012, submissions made and the documents filed on record, the present suit under Order XXXVII CPC, is hereby treated as ordinary civil suit for recovery of money. Issue summons of the suit for settlement of issues for service upon the defendants permissible through all or any of the approved modes including ordinary process, registered speed post, approved -- 1 of 2 -- courier and/or e-modes (WhatsApp/email) on filing of PF within a weekreturnable on 18.01.2027. Registered Post and Courier be given dasti. Internet generated tracking report and affidavit of service through e-modes be filed.
