Present: Ms. Sharadha Kushwaha, Ld. Counsel for the plaintiff
(through VC).
Submissions heard. File perused. The plaint is signed on
every page. The non-starter report from DLSA and statement of truth
have also been filed.
The dispute in the present suit is a commercial dispute for
recovery of outstanding dues from the defendant. The plaintiff seeks a
decree for recovery of Rs. 9,39,298/- along with pendente lite and
future interest.
Defendant no. 1 is a company and defendants no. 2 and 3
are directors. The plaint does not contain any averment on which the
directors would be personally liable. Defendants no. 2 and 3 are
dropped from the array of parties. Amended memo of parties be filed.

Issue summons for settlement of issues to the defendant
on filing of PF/RC/AD, authorised courier and speed post AD within
seven days, for 10.01.2025 at both addresses. Plaintiff shall forward
soft copies of the plaint, documents etc. at the email Id of the court.
Ahlmad is directed to forward the aforesaid soft copies on
the e-mail ID of Nazarat Branch at the earliest as also summons for
settlement of issues to be served upon the defendant on email ID of
defendant, mentioned in memo of parties.
