Fresh appeal received by way of assignment. It be checked and
registered as per rules.
Present:- Sh. Brijesh Kumar Sharma, Ld counsel for appellant
alongwith appellant.
Submissions heard. Record perused.
Vide order on sentence dated 14.09.2026 passed by Ld.
Trial Court, appellant was sentenced to simple imprisonment of 09
months and to pay fine of Rs. 33,40,000/- as compensation to the
complainant within 30 days and in default of payment of
compensation, the appellant was sentenced to undergo simple
imprisonment for a period of 06 months.
An application seeking suspension of sentence dated
14.09.2026 and for grant of bail is pressed on behalf of the
complainant.
Considering the submissions made and totality of
circumstances, the appellant is directed to deposit 20% of the
compensation amount by way of FDR in the name of Court on or
before the NDOH in terms of section 148(1) of NI Act. Subject to
deposition of aforesaid compensation amount, operation of the
sentence dated 14.09.2026 is hereby suspended under Section 430
BNSS till pendency of the present appeal.

Appellant is further admitted to bail on his furnishing a
personal bond in the sum of Rs. 25,000/- alongwith one surety in the
like amount. Bail bond is furnished and same is accepted.
Let notice of appeal be issued to respondent on filing PF
and RC for next date of hearing.
Put up for reply and arguments on 16.01.2027. Trial
Court Record be also called for the date so fixed.
