Ld. counsel for the defendant submits that expenses
of Ld. Local commissioner has been paid by the defendant on
10.12.2025.
Ld. counsel for the defendant submits that
inadvertently one application under Order VII Rule 11 (a) r/w
Section 151 of CPC was filed on behalf of the defendant on
05.03.2025 through e-filing portal but same was not filed
physically before the court. He further submits that on
13.08.2025, another application under Order VII Rule 11 (a) and
(d) r/w Section 151 CPC was filed behalf of the defendant. He
further submits that today hard copy of application under Order
VII Rule 11 r/w Section 151 of CPC, which was filed through e-
filing portal on 05.03.2025 is filed on record.
Ld. counsel for the defendant further submits that
now upon instructions from defendant, he wishes to withdraw the
application under Order VII Rule 11 (a) r/w Section 151 of CPC
filed on behalf of defendant on 05.03.2025 and he may be
permitted to withdraw the same.
Separate statement of Ld. counsel for the defendant
has been recorded to this effect.

In view of statement made, application under Order
VII Rule 11 r/w Section 151 of CPC filed on behalf of defendant
on 05.03.2025 stands dismissed as withdrawn.

Ld. counsel for defendants seeks time to file
judgments in support of his contentions. Let the same be filed
