File is taken up today on application for seeking restoration of
application for waiver of cost of Rs. 5,000/- moved on behalf of DH.
Ld. Counsel for DH has submitted that he could not appear
before this Hon’ble Court on 02.09.2026 and application for waiver of cost
moved on behalf of DH was dismissed for non prosecution. It is further
submitted that non appearance was neither deliberate nor intentional but due
to the reason cited above. It is prayed that application for waiver of cost may
be restored and cost imposed on the DH may be waived.
Heard.
Though the conduct of the DH is not upto mark as it was
second time when warrant of attachment could not be executed on account
of fault of DH, yet in view of persistent request of ld. Counsel for DH,
application for waiver of cost is hereby restored and cost of Rs. 5,000/- is
hereby reduced to Rs. 2,500/- to be paid with DLSA, East District.
Application disposed of.
Put up for purpose fixed on date already fixed.
