Mr. Rajeev Ranjan Shukla and Mr. Shashank Pandey, Ld. Counsel for defendant no.1 along- with the defendant no.1. Arguments heard on the application u/s 151 CPC seeking recalling of order dated 23.01.2025 whereby right of defendant no.1 to file WS was closed. It is submitted by Ld. Counsel for defendant no.1 that defendant no.1 could not file the WS within stipulated period due to his medical reasons and medical documents are also filed by defendant no.1 along-with the said application. It is stated by Ld. Counsel for plaintiff that plaintiff has no-objection, if the said application is allowed, however, subject to some cost. In view of the submissions made by Ld. Counsel for defendant no.1 and no-objection given by Ld. Counsel for plaintiff, the aforesaid application is disposed of as allowed subject to cost of Rs.1,000/- to be paid by defendant no.1 to the plaintiff. Ld. Counsel for defendant no.1 submits that he is -- 1 of 2 -- also representing defendant nos.2 (a to c) in the present matter and undertakes to file vakalatnam on their behalf within two weeks from today. Same be filed within two weeks from today. At this stage, Ld. Counsels for both the parties submit that there are chances of settlement between the parties and seek adjournment for referring the matter to the mediation centre for want of parties.
