In response to the court notice, process server
appeared today and files report on summons issued vide order
dated 27.09.2024.
Let a show cause notice be issued to the process
server to explain as to why no action be taken against him for
dereliction of duty.
As per the report of process server qua service of
defendant no.1 although defendant no. 1 has been served through
his son, however, the address of defendant no.1 as mentioned in
summons is incorrect and the correct address is 5/322,
Khicharipur, Delhi instead of 8/322, Khicharipur, Delhi.
Ld. Counsel for the plaintiff is directed to take
corrective steps regarding address of the defendant no. 1.
An application under Order 1 Rule 10 CPC is
moved on behalf of the plaintiff for impleadment of Smt. Batiya
Devi, wife of late Sh. Sita Ram. Copy supplied to opposite party.

Written statement is filed on behalf of the defendant
no. 5. Copy supplied to opposite party.
However, no written statement filed on behalf of the
defendant no. 1, 2(a) to 2(b), 3 and 4 till date.
Ld. Counsel for the defendant no.2(a) to 2(b),
defendant no.3 and defendant no.4 seeks some more time to file
written statement.
Let the same be filed within stipulated time with
advance copy to the opposite party.
Put up for reply and arguments on the application
under Order 1 Rule 10 CPC/filing of written statement on behalf
of defendant no.2(a) to 2(b), defendant no.3 and defendant no.4
and for taking corrective steps regarding address of defendant
no.1 on 17.04.2025.
