Submissions heard. File perused.
Present is a suit for eviction, possession, recovery of
arrears of rent, damages and mesne profits. The plaint is signed on
every page. Plaint does not contain the verification clause. Statement
of truth has been filed but it contains a blank. NSR is on record.
Certificate under Section 63 BSA has been filed. Declaration under
Order 11 Rule 6 CPC as amended by CC Act has not been filed. The
plaint is also accompanied with an application under Order 39 Rule 10
read with Section 15A CPC.
The plaint does not contain any mention about the pre-
institution mediation. Further, complete address of the shop is not
noted in the plaint. Jurisdiction is claimed on the basis of the location
of the property, which cannot be ascertained without the complete
address. Site plan too has not been filed.

The suit has been filed against Rishabh Sharma as
defendant no.1, Dy. Commissioner, MCD as defendant no.2 and
Executive Engineer, EMD-6, DDA as defendant no.3. There is nothing
in the plaint which requires defendants no.2 and 3 to be parties in the
suit. Their names are deleted from the array of parties.
Time is sought to remove the objections. Matter be listed
for said purpose/further proceedings on 03.11.2026.
