Fresh vakalatnama has been filed on behalf of
defendant no. 2. Same is taken on record.
As per record, qua defendants no. 1 and 2, service
was directed by way of publication. Ld. Counsel for the
defendant no. 2 submits that defendant no. 1 has already passed
away. He seeks time to place on record death certificate of
defendant no. 1, on the next date of hearing. He has further
submitted that copy of plaint along with documents have not
been supplied. Ld. Counsel for the plaintiff is directed to supply
the same at the earliest against acknowledgment. WS shall be
filed thereafter within time.
WS on behalf of defendants no.3 and 6 is already on
record. However, no WS has been filed on behalf of defendant
no. 4 till date.

Two separate applications under Order I Rule 10 CPC seeking
deletion from the array of parties were filed on behalf of
defendants no. 3 and 4. Another application under Order VII
Rule 11 CPC on behalf of defendant no. 6 is also on record. Time
is sought by the Ld. Counsel for the plaintiff for filing replies
thereto. Be filed by the next date of hearing with an advance
copy to the opposite side. the next date of hearing.
It is further noted that defendant no. 5 remains
unserved till date. In the interests of justice, an opportunity is
granted to the plaintiff to file fresh address, if any, of the
defendant no. 5.
