Matter is fixed for arguments / disposal of
application under Order VI Rule 17 of CPC filed on behalf of the
defendants.
At this stage, Ld. Counsel for the defendants
submits that upon instructions from all the defendants, he wishes
to withdraw the application under Order VI Rule 17 of CPC filed
on behalf of the defendants on 22.04.2025 and prayed that he
may be permitted to withdraw the same with liberty to file afresh.
Separate statement of Ld. Counsel for defendants
has been recorded in this regard.
Ld. Counsel for the plaintiff opposes the withdrawal
of the said application submitting that by moving the said
application defendants have delayed the proceedings of the case
and cost may be imposed upon the defendants.
In view of submissions, application under Order VI
Rule 17 of CPC filed on behalf of the defendants on 22.04.2025
stands dismissed as withdrawn with liberty to file afresh subject
to cost of Rs. 2,000/- to be paid to the plaintiff.

Ld. Counsel for the defendants seeks time to file
fresh application under Order VI Rule 17 of CPC. Let the same
be filed with advance copy to opposite party.
Put up for filing of application under Order VI Rule
17 of CPC as well as reply and arguments thereof, on
04.10.2025.
