Record perused.
Vide order dated 17.08.2026, Ld. Link Court had
stayed the operation of order dated 23.07.2026 passed by the
executing court whereby warrants of possession were directed to
be issued.
It has been apprised that in connected appeal RCA
67/25, the stay order became infructuous as warrants of
possession had already been executed by the Bailiff by the time
the order was passed, however, in the present matter, warrants of
possession are yet to be executed in view of stay passed by said
order.
Ld. counsel for the respondent submits that notice of
the application was not issued to the DH / appellant as directed
by Ld. Link Court. He further submits that affidavit of
compliance has not been filed on behalf of the DH/ appellant.
Ld. counsel for the DH / appellant submits that he
would file the same during the course of the day.
Ld. counsel for the respondent submits that false
submissions were made before Ld. Link Court regarding stay
order granted by Hon’ble High Court of Delhi. It has been

submitted that stay order was passed in CS no. 224/2023, which
has no bearing to the facts of the present case.
Ld. counsel for the appellant also submits that the
matter pending before Hon’ble High Court of Delhi is a different
matter and that nothing was concealed while making submissions
before the Ld. Link Court on 17.08.2026.
Put up for arguments on present appeal as well as on
application seeking stay of proceedings on 16.09.2026 at 11:30
AM.
