files fresh vakalatnama alongwith defendant.
WS filed alongwith an application under Order 8 Rule 1 CPC
seeking condonation of delay in filing the same. It is stated in the
application that the defendant was served on 20.05.23 whereas the WS
has been filed today i.e. on 07.08.23. Thus, there is a delay of about 47
days.
However, considering the fact that the WS has been filed within
120 days, the delay is condoned subject to cost of Rs. 1,500/- and WS is
taken on record.
Affidavit of admission-denial of documents filed by the defendant.
Copy supplied.
Let replication be filed alongwith affidavit of admission-denial of
documents by the plaintiff after supplying advance copy to Ld. Counsel
for the defendant.
Case be listed for completion of pleadings and framing of issues
on 04.09.23.
