Ld. Counsel for the defendants filed an application
seeking three reliefs- one is under Order IX Rule 7 CPC, second
under Section 5 of the Limitation Act for setting aside ex-parte
order dated 22.12.2025 and third recalling the order dated
13.11.2024 by which rights of the defendants to file written
statement was closed. Copy supplied.
Ld. Counsel for the defendants submitted that this
application may be treated as an application for seeking a relief
under Order IX Rule 7 CPC and for other reliefs separate
appropriate applications shall be filed within 7 days from today.
Keeping in view the submissions of Ld. Counsel for
the defendant, the present application is treated as an application
under Order IX Rule 7 CPC. The defendant is at liberty to move
separate appropriate applications seeking the other reliefs with
advance copy of the same to the opposite side at least 30 days prior
to the next date of hearing.
As such be listed for arguments on the pending
application(s) on 27.04.2026.
