Heard on both the transfer applications. Files
perused.
By way of this common order, I shall dispose of TP
No. 48/25 and TP No. 49/25. In TP no. 48/25, transfer of CS no.
957/2023 has been sought from the court of Sh. Ayush Sharma,
Ld. Civil Judge, East District to the court of Sh. Vinik Jain, Ld.
ACJ-CCJ-ARC, East District where CS no. 956/2023 filed by
applicant Kamal Kant Gupta is pending adjudication. In TP No.
49/2025, it is mentioned that property in both the suits i.e. CS
No. 956/2023 and CS no. 957/2023 is the same and issue
involved is also the same. It is prayed that in order to avoid
conflicting judgments, both the suits may be transferred to one
court. Ld. counsel for applicant Pooran Singh also submits that
he has no objection if suit i.e. CS no. 957/2023 is transferred to
the court of Sh.Vinik Jain, Ld. ACJ-CCJ-ARC, East District
where another connected suit i.e. CS no. 956/2023 is pending
adjudication.

In view of no objection given by Ld. counsel for
applicant Pooran Singh and considering that suit property and
issues involved in both the suits are same, it will be in the ends of
justice if both the suits are adjudicated by the same court in order
to avoid conflicting judgments. Accordingly, CS no. 957/2023
is withdrawn from the court of Sh. Ayush Sharma, Ld. Civil
Judge, East District and is transferred to the court of Sh.Vinik
Jain, Ld. ACJ-CCJ-ARC, East District.
Both the transfer applications bearing TP No. 48/25
and TP No. 49/25 are disposed of.
Parties are directed to appear before the transferee
Court on 05.12.2025 at 10.00 a.m.
Copy of this order be sent to both the transferor and
transferee Court for information and compliance.
Concerned Ahlmad is directed to send the file to the
transferee Court immediately.
Files of transfer applications be consigned to
record room.
