Previous cost has been deposited.
One application for seeking change of AR has been
filed. Application is allowed. AR is substituted.
Another application under Order V Rule 20 of CPC has
been filed for seeking permission to serve the defendant through
substituted service. However, a perusal of the record shows that
initially the defendant was served through his father but despite the
same defendant did not appear and he was proceeded ex-parte vide
order dated 25.07.2023.
On 25.08.2023, father of defendant appeared in the
Court and stated that he has disowned the defendant and furnished
fresh address of the defendant. Thereafter, Ld. Predecessor of this
Court, directed the plaintiff to serve the defendant at the said address.
However, it appears that no notice was sent at the address of the
defendant, which was mentioned by father of the defendant in his
application filed on 25.08.2023. The said address is “Amar Gupta R/o
107, Green Valley Residency, Aman Vihar, Dehradun – 2480001.”
The plaintiff is directed to take fresh steps to serve the
defendant at his above mentioned address on filing PF / Registered
A.D., speed post, courier. Ordinary summon be served through
District Judge, Dehradun, Uttarakhand. Necessary steps be taken
within 7 days.
Re-notify on 29.11.2024.
