Present : Sh. Prashant Sharma, Ld. Counsel for the plaintiff.
This is a suit for declaration of title to the suit
property, mandatory injunction directing defendants to vacate
and handover the physical vacant possession to the plaintiff,
prohibitory injunction restraining alienation and recovery of
mesne profits.
Ld. Counsel for the plaintiff has moved an
application under Order VII Rule 14 (3) r/s Section 151 of CPC
on behalf of the plaintiff for leave to place on record copy of the
will.
Submissions heard. Record perused.
It has been submitted that due to inadvertence, same
could not be filed alongwith plaint. In view of submissions, the
application is allowed. Copy of will is taken on record.
Let summons for settlement of issues be issued to
the defendant on filing of PF/RC, speed post, approved courier
and through all acceptable modes of services, returnable on
06.11.2026.
Steps be taken within 07 working days.
