Summons issued to the defendants have not been
received back. However, speed post has been received back with
the report of
‘refusal’.
It appears that despite directions of the Court on last
date of hearing, the summons were not served on the defendant
through affixation.
Let the report be called from Nazarat Branch, East,
KKD regarding non service of defendant by way of affixation,
despite clear directions contained in the order dated 23.12.2025.
It is also seen that though the defendants are stated to
have been served through Whatsapp, however, no affidavit
mentioning the Whatsapp contact numbers/ e-mail ID of the
defendants has been filed by the plaintiff.
As such, issue fresh summons of the suit to both the
defendants in the prescribed format of Order XXXVII CPC to be
executed by way of the affixation as well as through Whatsapp on
filing of PF/Copies/Speed post and through all acceptable modes of
services for 16.11.2026. Plaintiff is directed to file affidavit
mentioning the e-mail ID/ Whatsapp numbers of the defendants.
Steps be taken within one week from today.
