This Detailed Accident Report (DAR) is treated as petition in
view of section 166 (4) of the M.V. Act. Be registered accordingly.
Heard. It is submitted by the injured that she suffered grievous
injuries in a motor vehicular accident occurred on 23.07.2025 within
jurisdiction of PS Shakarpur. It is further submitted that since the identity of the
offending vehicle and driver could not be ascertained, she does not want to
proceed with the accident claim case and sought permission to withdraw the
accident claim case with liberty to get it revived as and when the offending
vehicle is traced. It is further submitted that she has already given his statement
before the court of Ld. JMFC-05, East for accepting untraced report filed in the
criminal case, today itself. Separate statement of injured petitioner is recorded
in this regard.
In view of above, the present accident claim case is dismissed as
withdrawn with the liberty, as prayed for.
Further, considering the request of the petitioner that she has
suffered grievous injuries due to the accident. Accordingly, in the given facts
and circumstances of the case, matter is recommended for grant of
compensation to the injured under Delhi Victim Compensation Scheme.
A copy of the order be sent to the Ld. Secretary, DLSA (East) for
doing the needful.
A copy of the order be given dasti to the petitioner, as prayed for.
Let the file be consigned to Record Room.
