None for defendant no. 3.
On the last date of hearing, Ld. Counsel for the
plaintiff again sought an opportunity to place on record
fresh/additional address of the defendants.
Today, the same is filed by way of a miscellaneous
application under Section 151 CPC i.e. bearing IA/1/2026. The
address is as under :
Property No. 17, Street No. 3, Aram Park, Shastri
Nagar, New Delhi.
Accordingly, the plaintiff is directed to take
appropriate steps for the service of defendants on the above
mentioned address within 7 days from today.
The application under Section 151 CPC for filing
fresh address of the defendants is disposed of accordingly.
Amended memo of parties filed by the plaintiff. Be
taken on record.
Another application under Section 151 CPC seeking
waiver of the cost imposed vide order dated 30.05.2026 upon the
plaintiff, filed by the plaintiff.
Perusal of the record transpires that the plaintiff
failed to comply with the mandate of the orders dated 06.02.2026

and 30.03.2026. Further, on 30.05.2026, the plaintiff again
sought another opportunity to take appropriate steps for service
of defendants. However, the plaintiff failed to take steps and
subject to cost of Rs. 500/-, one more opportunity was granted to
the plaintiff to take appropriate steps for service of defendants.
Though, there is no ground to recall the order but in
the interest of justice, the same is allowed and the cost is waived
off.
Plaintiff has specifically sought a date in the end of
September, 2026.
Granted.
Be listed for further proceedings on 30.09.2026.
The date has been given as per the convenience and
request of Ld. Counsel for the parties.
