Accused Nazim is absent.
Present charge-sheet has been filed along with an
application seeking condonation of delay in filing the present charge-
sheet.
Perused the case file. The complaint was filed within the
period of limitation and as per the judgment of Hon’ble Supreme
Court in Amrit Lal Soni vs Shanti Lal Soni, the relevant date for
computation of period of limitation can be considered from the date of
filing of complaint and not from the date of registration of FIR. In
view of the same, the delay is condoned.
Charge-sheet discloses that the offence of commission of
theft of electricity has taken place. Cognizance of offence is taken and
accused persons are summoned to face trial.
At this stage, accused Nazim is absent on first call.
Thereafter, the matter was fixed for 12:30 pm awaiting the presence of
the accused Nazim and/or his counsel but at 12:30 pm also none
appeared. Thereafter, the matter was fixed for 2:00pm.

None for accused.
None has appeared on behalf of accused Nazim despite
repeated calls. Therefore, it appears that the accused Nazim is
deliberately trying to evade appearance. Hence, BWs in the sum of Rs.
5,000/- be issued against the accused Nazim through SHO PS
concerned for NDOH.
Put up for appearance of accused persons/framing of notice
on 02.03.2026.
