None for defendant.
Matter is listed for completion of pleadings,
admission denial of documents and for framing of issues.
Despite repeated calls since morning, none has
appeared on behalf of the defendant.
On the last date of hearing i.e. 25.05.2026, this Court
granted another opportunity to the defendant to file written
statement, however, despite that, no written statement has been
filed so far.
Ld. Counsel for the plaintiff requested that the
defendant is deliberately delaying the matter and therefore, no
further opportunity may be granted to the defendant and the suit
may be proceeded
exparte.
This Court finds force in the submissions of the Ld.
Counsel for the plaintiff as the defendant was appeared before
this Court on 09.04.2026 and on his request, the copy of the
plaint and documents annexed to it, was supplied to him and it
was directed to him to file the written statement within 30 days
from that day, however, no written statement was filed by him
and therefore, in the interest of justice, this Court granted one
more opportunity to the defendant to file the written statement
vide order dated 25.05.2026. However, despite availing of

repeated opportunities, the defendant has failed to file written
statement and therefore, it is evident that the defendant is not
contesting the suit diligently and therefore, this Court is not
inclined to given any further opportunity to the defendant and the
defendant is hereby proceeded

parte.
