This Court is working with only one personal assistant as one of
the regular personal assistant is on leave today.
Present : Sh. Yogesh Kumar Goel, Ld. Counsel for plaintiff.
Sh. Shatrughan Bhagat, proprietor of the defendant in
person.
It is submitted by the Ld. Counsel for the plaintiff that
the present suit has been filed under Order XXXVII CPC and the
same may be treated as an ordinary suit.
Heard.
In view of the submissions of the Ld. Counsel for the
DH, the present suit is treated as an ordinary suit.
On the last date of hearing, summons of the suit were
issued upon the defendant and as per report, the defendant has
been served by way of affixation on 30.03.2026.
The proprietor of the defendant submitted though he
has not received any summons from the Court but he had receved
a call from the Ld. Counsel of the plaintifff, thus, he has appeared
before this Court.
It is submitted by the defendant that the address, email
and the contact number as mentioned in the memo of parties is his
address, email and contact number. He has provided copy of his
adhaar card.

Copy of the plaint and documents supplied to the
defendant.
Defendant is directed to file the written statement with
in 30 days from today alongwith an application seeking
condonation of delay, if any with supply of copy of the same to the
opposite side.
Replication, if any, be filed with supply of advance
copy of the same to Ld. Counsel for defendant at least 15 days
before the next date of hearing.
Both parties are directed to file affidavit of
admission/denial of documents and proposed issues with supply of
advance copy to each other at least 15 days before the next date of
hearing.
Be listed for completion of pleadings, admission
denial of documents and for framing of issues on 25.05.2026.
The date has been given as per the convenience of Ld.
Counsel for both the parties.
