advocates for decree holder.
Sh. Mohit Bhardwaj, advocate for JD.
Counsel for decree holder placed on record copy of the order
of Hon’ble High Court dated 09.09.2026 which shows that appeal
of the JD filed against the decree dated 19.05.2026 has been
dismissed.
As per the decree, the JD was required to pay sum of Rs. 4
Lakhs to the decree holder alongwith interest @ 6% per annum
from the date of filing of the suit i.e. 05.07.2024 till realization
alongwith costs.
Nazir is directed to calculate the amount of the decree which
is payable by the JD. However, counsel for decree holder stated
that roughly the amount will be approximately Rs.4,60,000/-.
Counsel for the JD requested for sending the matter to
mediation which is accepted by the counsel for decree holder.
Hence, the matter is sent to the Mediation Cell for exploring
the possibility of compromise and parties to appear there on
18.09.2026 at 12:00 p.m.
Report of the mediation is awaited for 03.10.2026. In case,
the matter is not settled, then the JD has to make the entire amount
of the decree, otherwise coercive action will be taken against him.
