Present: Sh. Anuj Gupta, Ld. Counsel for DH alongwith SPA
holder of plaintiff (both through VC).
Ms. Saguna Gupta, Ld. Associate Counsel (Enroll. No.
D-12119/2022) in person.
None for JD No. 3 (a).
Perusal of record transpires that on the last date of
hearing, notice of the present execution petition was directed to be
issued to the JD Nos. 1 and 8 and the DH/any authorised person on
behalf of the DH was also allowed to accompany the process server.
At this stage, Ld. Counsel for the DH submits that JD
Nos. 2 to 7 had already been proceeded against ex-parte in the main
suit bearing No. CSDJ/1185/2016 (Old No. 170/2010). Accordingly,
it is prayed that JD Nos. 2 to 7 may be dispensed with in the present
execution proceedings.
In view of the submissions made by Ld. Counsel for
the DH, JD Nos. 2 to 7 are dispensed with in the present execution
petition.
As per report from Nazarat Branch, summons sent to
JDs No. 1 and 8 received remained unserved, as the property of JDs
No. 1 and 8 found locked.
It is submitted by the Ld. Counsel for the DH that JDs
No. 1 and 8 are very much available on the given address and they
are deliberately avoiding the service of notice, hence, a liberty has

been sought for by the DH to accompany the process server for the
service of JDs no. 1 and 8.
In the interest of justice, opportunity granted. Issue
notice of the present execution petition upon the JDs no. 1 and 8 on
filing necessary process fee within 7 days from today.
The DH/any authorised person on behalf of the DH is
allowed to accompany the process server.
In case of non-availability of the JDs no. 1 and
8/evasion/premises found locked/refusal, the JDs no. 1 and 8 be
served by way of affixation by affixing the summons/notice on the
conspicuous part of the address of the JDs no. 1 and 8.
The process of affixation shall be got photographed at
the cost of the DH. The photographs shall be handed over by the
DH to the process server, for being filed alongwith the report.
As such, be listed for further proceedings on
19.11.2026.
Date is given as per the choice and convenience of the
Ld. Counsel for the parties.
