Matter is fixed for order on application under Order
XXXIX Rule 1 and 2 r/w Section 151 CPC / filing of affidavit of
admission-denial of documents / framing of issues.
However, for disposal of application under Order
XXXIX Rule 1 and 2 r/w Section 151 CPC, statement of parties /
their AR need to be recorded.
Ld. counsel for the parties submit that plaintiff and
defendants / their ARs are not available today for recording of
their statement.
Plaintiff and defendants / their ARs are directed to
be present in person on the NDOH for recording of their
statement.
Ld. counsel for defendant no. 4 submits affidavit of
admission - denial of documents has already been filed.

Ld. counsel for remaining defendants seek time to
file affidavit of admission-denial of documents and therefore,
request an adjournment.
At request, put up for filing of affidavit of
admission-denial of documents on behalf of defendants/ framing
of issue / order on application under Order XXXIX Rule 1 and 2
r/w Section 151 CPC, on 06.11.2025.
