Sh. D. K. Malhotra, Ld. LSA for defendant no. 2 along with
defendant no. 2.
Defendant no. 2 paid cost of Rs. 1000/- to the Ld. Counsel for the
plaintiff.
Ld. Counsel for both the defendants submit that they have no
objection, if the application under Order 16 rule 1 and 2 CPC filed by the
plaintiff is allowed.
In view of the submissions, the application under Order 16 rule 1
and 2 CPC is allowed and disposed off.
Ld. Counsel for the plaintiffs submits that he wish to withdraw the
application under Order XI Rule 14 R/w Section 151 CPC dated 20.07.2026.
Separate statement of Ld. Counsel for the plaintiffs has been
recorded to this effect. Accordingly, application under Order XI Rule 14 R/w
Section 151 CPC dated 20.07.2026 is dismissed as withdrawn and disposed off.
Ld. Counsel for the plaintiff moved an application under Order 11
Rule 12 CPC seeking direction to defendant no. 1 and 2 to get disclose and
discover all other movable and immovable assets of the deceased parents other
than the suit property.
Ld. Counsel for both the defendants submitted that they have no
knowledge of any other property of the deceased parents other than that of the
suit property.

Separate statements of defendant no. 1 and 2 have been recorded to
this effect.
In view of the submissions of the Ld. Counsel for the defendants,
nothing is left to be done with the application under Order 11 Rule 12 CPC.
Accordingly, the present application under Order 11 Rule 12 CPC is disposed
off.
Put up for further proceedings i.e. framing of issues on 12.10.2026.
